Lusa - Business News - Portugal: Draft bill aims to let companies stagger workers' timetables

Lisbon,Sept.15,2020(Lusa)–Companies in Lisbon and Porto will be able to stagger entry and exit times, having only to consult workers and representatives beforehand, and there will be workers who are not obliged to accept the change.
The measure is included in the proposed decree law that the government has sent to both sides of industry and to which they are asked to send their opinion by the end of next Wednesday, before the law is approved by the Council of Ministers.
The draft bill, to which Lusa had access, is one of the measures contemplated in the Council of Ministers' resolution that declares the contingency situation in the scope of the pandemic on the creation of differentiated entry and exit schedules or breaks and meals by companies in the Lisbon and Porto metropolitan areas.
"The employer may change working hours, unless such change causes serious harm to the worker, through prior consultation with the workers involved and the workers' commission or, failing that, the union or inter-union commission or the union delegates, posting the new working hours at the company at least five days before they begin to apply", reads the document.
The alteration to staggered schedules aims to avoid groupings in the company and contribute to a lower concentration of people who use public transportation during peak hours.
According to the document, the creation of differentiated timetables at entrances and exits, breaks or shift changes must be observed in workplaces, "including common areas, support facilities and access areas" where 50 or more workers work simultaneously.
Companies will have to organize time gaps between the different teams or departments with minimum breaks of 30 minutes between them up to an hour.
The diploma also provides for the creation of stable work teams to ensure that contact only takes place between workers from the same team or resort to teleworking whenever the activity allows it.
Non-compliance with these rules is subject to a misdemeanour regime, with the Authority for Working Conditions being the entity that will have the competence to carry out the necessary inspections.
The secretary general of the UGT, Carlos Silva, understands that the diploma leaves "an open field" for "pressure on workers" who, he believes, will have little margin to refuse and invoke serious harm.
To Lusa, Carlos Silva also warned of the fragility of the prior consultation provided for in the document in cases where union structures and workers' representatives do not exist in the companies and criticized the fact that the government is preparing to approve the diploma without first discussing it with the social partners, only asking them to deliver an opinion.
"It is one thing to expose concern in a tripartite environment, but another to send written opinions," he said, stressing that this is not the listening to the social partners "foreseen in the social dialogue.
In order to control the spread of Covid-19, the government has put mainland Portugal in a contingency situation from 00:00 today until September 30.
