Évora, Portugal, March.27,2024(Lusa)- The start of the trial in the case of the collapse of a quarry road in Borba, in the district of Évora, has been postponed until October due to the health of the chairwoman of the panel, one of the lawyers said on Wednesday.
Speaking to the Lusa news agency, Silvino Fernandes, who defends the mayor and deputy mayor of Borba and the municipality itself, said that the postponement was due to the health of the judge who will be hearing the case.
The notification from the Évora District Court sent to the defendants, to which the Lusa news agency had access today, said that the previous dates have been cancelled and new ones have been set.
According to the document, the trial will no longer begin next Wednesday, as was originally planned, and will now take place on 3 October.
In addition to the first session, sessions have also been scheduled for 04, 08, 09, 15, 16, 23, 24, 25, 29 and 30 October, as well as 05, 06, 13, 14, 19, 20 and 21 November, the notification adds.
The trial, with six defendants in the dock, will take place in the main courtroom of the Évora District Court.
On the afternoon of 19 November 2018, a section of around 100 metres of the Municipal Road 255 (EM255), between Borba and Vila Viçosa, collapsed due to a large volume of rocks, marble blocks and earth sliding into two quarries.
The accident caused the deaths of two workers from a marble extraction company in the quarry that was still active and three other men, occupants of two vehicles that were travelling on the section of road that collapsed and fell into the water level of the quarry that was no longer active.
In the case referred for judgment, the mayor of Borba, António Anselmo, is charged with five counts of murder, while the deputy mayor, Joaquim Espanhol, is charged with three counts of murder by omission.
The company ALA de Almeida Limitada, which held the quarry's operating licence and whose manager has since died, and the technical manager Paulo Alves have each been charged with 10 counts of violating safety rules.
For their part, Bernardino Piteira and José Pereira, employees of the Directorate-General for Energy and Geology (DGEG), have been charged with two offences of homicide by omission.
At the same time, the state filed an administrative action with the Beja Administrative and Fiscal Court to recover more than 1.6 million euros paid in compensation to the victims' families.
The six defendants, together with Borba Town Council and the three heirs of the manager of the company ALA de Almeida Limitada, are the targets of the administrative action brought by the state.
At the very least, the Borba town council and mayors have contested the action brought by the state. One argument concerns the "prejudicial question of this action in the face of the pending criminal proceedings," considering that "the state does not have the right it invokes."
The 19 relatives and heirs of the five fatal victims of the collapse received compensation from the state totalling around €1.6 million, the transfer orders for which were finalised in 2019.
