Lusa - Business News - Macau: Government rejects EU report warning of 'danger to fundamental rights'




Macau, China, June 14,2024 (Lusa) - Macau's government on Friday repudiated the EU's annual report on the territory, whose conclusions warn that "the continued increased focus on national security could endanger fundamental rights" in the territory.
"The Government of the Macau Special Administrative Region [SAR] expresses its deep displeasure and firm opposition to such an occurrence," it said to a statement. "The revision of the Law on the Defence of State Security was based on the experiences of various regions, giving sufficient consideration to the tradition of Macau's legal system and the real situation of society, in strict compliance with international human rights conventions."
The executive, which is led by Ho Iat Seng, considered that the "revision of the Electoral Law for the Chief Executive and the Electoral Law for the Legislative Assembly and other laws by the Macau SAR, is not only essential for the implementation of the principle 'Macau governed by patriots', the defence of national security, and the improvement of the relative electoral regimes, but also to better safeguard the exercise of residents' right to vote."
Some 25 years after the transfer of administration of the territory from Portugal to China, "the implementation of the 'one country, two systems' principle and the Basic Law of Macau has been successful, facts that the European Union cannot deny and which it is expected to view objectively and fairly," it said. "Macau's affairs are China's internal affairs, so the European Union has no right to interfere.
"The publication of this annual report has no legitimate basis in international law," the statement continues. "The European Union has stated on several occasions that it values the cooperative relationship with Macau, so we hope that the European Union will introduce more positive and useful elements, promoting the development of bilateral relations with practical actions."
On Thursday, the European Commission and the EU's High Representative for Foreign Affairs and Security Policy, Josep Borrell, warned that "a continued increased focus on national security could jeopardise fundamental rights in Macau, eroding the 'one country, two systems' principle and the usually high degree of autonomy" in the region.
"In 2023, Macau adopted several laws to implement a political doctrine of 'patriotic leadership in Macau'," the report notes. "For example, with regard to the 2009 National Security Law, the amendments adopted in May [2023] expand the scope of the law. The Law on the Protection of State Secrets, an extension of the National Security Law, was adopted in December and gives additional powers" to the person in charge of Macau's administration.
