Lusa - Business News - Portugal: Judg accepts BES/GES appeals, case not suspended
Lisbon, April.23,2024(Lusa) - The judge in the BES/GES case has accepted 96 appeals by thousands of victims against the separation of Banco Espírito Santo's (BES) compensation claims to the civil courts, but without suspensive effect that could postpone the trial. According to the court order published by Observador and to which Lusa also saw, Judge Helena Susano took the view, "contrary to some appellants, that this appeal does not have suspensive effect". However, the magistrate of Lisbon's Central Criminal Court acknowledged in her order that "this understanding does not bind the High Court", so the Lisbon Court of Appeal - where these appeals are lodged - can still grant suspensive effect and thus jeopardise the start date of the trial. The trial in the BES/GES case - also known as the Espírito Santo Universe - is scheduled to begin on 18 June. The acknowledged appeals challenge the January decision to move the compensation claims from the criminal to the civil courts. The case contained 1,306 civil claims (relating to 2,475 victims) which the magistrate separated on the grounds that it would "delay the trial intolerably". The trial in the Universo Espírito Santo criminal case will begin almost a decade after the collapse of the Espírito Santo Group (GES) in August 2014, and has former BES chairman Ricardo Salgado as the main defendant, accused of 65 offences, including criminal association, active corruption, document forgery, qualified fraud and money laundering. Considered one of the biggest cases in the history of Portuguese justice, this case brings together in the main case 242 inquiries, which have been joined, and complaints from more than 300 people, natural and legal, living in Portugal and abroad.
