Lusa - Business News - Portugal: Calls for total ban on politicians owning companies that deal with state

Lisbon,March,17,2023(Lusa)-Portugal's far-right party, Chega, said on Friday that it would propose a total ban on the participation of government leaders in companies that do business with the state after the Constitutional Court found against the party in three complaints of alleged incompatibilities.
At stake were submissions made by Chega to the Constitutional Court in October last year concerning the minister of health, Manuel Pizarro, the former minister of infrastructures, Pedro Nuno Santos, and the secretary of state for nature conservation and forests, João Paulo Catarino.
In a press conference, a member of parliament and president of Chega, André Ventura, announced that the party was notified of the opinions of the Public Prosecutor to the Constitutional Court, which in no case gave it reason, and considered that the judges made a "restrictive interpretation" of the law that regulates the exercise of functions by holders of political offices and senior public positions.
"The Constitutional Court considers, in a decision that will make jurisprudence unless we manage to change the law, that ministers can hold social participations, directly or indirectly, [in companies that do business with the state] as long as the areas they do business with are not under their control," he pointed out.
According to Ventura, this was the basis for the Court's decision not to consider that there were incompatibilities in the shareholdings in the companies of Pedro Nuno Santos and João Paulo Catarino.
In the case of Health Minister Manuel Pizarro, the opinion of the Public Prosecutor considered, according to Ventura, that there had been an incompatibility but that this had been resolved and therefore did not give rise to any sanction, which could be resignation.
"For us, it is a legal defeat, but we will not appeal the decision, the solution is to change the law in parliament," said Ventura.
Despite the fact that parliament is precisely discussing changes to the regime of public office holders, and with a proposal by Chega on the framework of sanctions, Ventura said that these decisions by the Public Prosecutor would justify a new proposal to change the law on two points.
"One of the changes we will propose will be that ministers have to remedy irregularities before taking office and that they cannot do so afterwards," he explained.
Secondly, "the prohibition of ministers and secretaries of state having stakes in companies that do business with the state, regardless of the area they oversee".
"Ministers and secretaries of state cannot have any stake in companies that do business with the state," he summarised.
The Chega leader considered that the law would be clear on this prohibition, but given this "restrictive interpretation" of the Court - which follows a previous opinion of the Consultative Council of the Attorney General's Office - he said that it was necessary to clarify it to avoid "promiscuities and dangerous connections" in the government.
When asked about another complaint made by Chega, which concerns the minister for territorial cohesion Ana Abrunhosa, Ventura said that the party had only received the three notifications it released today.
In the opinions that Chega has released to the media regarding Pedro Nuno Santos and João Paulo Catarino, it is stated that "there is no situation of legal impediment", as the members of the government do not hold shares in companies linked to the areas they oversee.
In the case of Manuel Pizarro, the opinion notes that there was a situation of legal incompatibility, but that was remedied by the same, "preventing any sanction" by the Constitutional Court.
In October last year, following news of alleged violations of the incompatibilities regime by several leaders, the government said that the law was being "fully complied with", considering that the reflection on this regime is the responsibility of parliament.
At that time, President Marcelo Rebelo de Sousa asked parliament to review the legal regime on the incompatibilities and impediments of holders of political offices, should it "consider such reflection relevant and necessary".
"Indeed, the complex legislative entanglement has raised wide controversy in Portuguese society, in a matter that is essential for citizens' confidence in institutions, which results from a constitutional imposition, doubts that have even been expressed by the Consultative Council of the Attorney General's Office," said a note posted on the website of the Presidency on 12 October.
