Lusa - Business News - Angola: Carlos Sao Vicente remanded in custody for further two months

Lisbon, Jan. 22,2021(Lusa)- The preventive custody of Portuguese-Angolan businessman Carlos São Vicente, who has been held since September in Luanda on suspicion of corruption, has been extended for a further two months, according to an order by the Angolan Attorney General's Office (PGR) to which Lusa had access on Friday.
According to the PGR ruling, of 20 January 2021, the deadline is "exceptionally" extended due to the "need to carry out the missing steps," and to the complexity of the case, specifically due to its international nature.
Carlos São Vicente is also being investigated in Switzerland for suspected money laundering.
"For this purpose, I am exceptionally extending the period of preventive custody of the accused, Carlos Manuel São Vicente, for a further two months, in view of the need to make further inquiries, because the case is of particular complexity especially the cross-border connections. In the event of the accused being released, the risk of fleeing would be high, which could jeopardise the investigation and the achievement of sound justice", reads the document.
The pre-trial detention of Carlos São Vicente, according to an opinion of the constitutionalist and law professor Jorge Miranda, requested by the family of the businessman, to which Lusa had access, "offends basic principles of the democratic rule of law".
The constitutionalist's opinion, dated 11 January, also states that the procedures of the Angolan PGR violate the Angolan Constitution.
"There are no signs in the process of the crimes charged that could justify being remanded in custody," and with Carlos São Vicente's assets already in the hands of the state and given his precarious health, "there is no danger of absconding nor of disturbing the process," the opinion stresses.
In an interview with Lusa this month, the wife of the businessman and daughter of the first President of Angola, Irene Neto, who is in Portugal, said that she had requested opinions from some "renowned Portuguese constitutionalists and that Jorge Miranda's considered the measure unconstitutional.
Carlos São Vicente is suspected of running "an illegal scheme," which has resulted in over US$900 million (around €763.6 million) of damage to state oil company Sonangol.
Between 2000 and 2016 he simultaneously acted as risk management director for Sonangol and chairman of the board of directors of AAA Seguros, a company in which the Angolan oil company was initially the sole shareholder, allegedly carried out "a scheme of illegal appropriation of shares" in the insurance company and "income and profits produced by the system" of insurance and reinsurance in the oil sector in Angola, thanks to the company's monopoly.
In this way, Carlos São Vicente became the "majority shareholder in AAA Seguros, with 89.89%, to the detriment of Sonangol, which saw its stake drastically reduced by 10% [to 10%], with an estimated loss of more than $900,000,000 [around €763.6 million at the current exchange rate]," and the oil company "received no benefit".
The transfer of shares, which according to the ruling, the defendant said had been made "on the basis of an informal agreement" between him, as representative of AAA Seguros, and the then chairman of the board of Sonangol, and later vice-president of Angola, Manuel Vicente.
Also according to the transcript, "a large part of Ativos das AAA Seguros, SA, which has already ceased activity, now belongs to other companies of the same group owned/controlled by the defendant Carlos São Vicente," through "a fraudulent process to the detriment of the Angolan state.
In view of the above, the document concludes "there is no doubt, of sufficient evidence that the defendant Carlos Manuel de São Vicente is involved in the practice of the crimes of embezzlement (...), undue receipt of advantages (...), corruption (...), economic participation in business (...) influence peddling".
The AAA, led by Carlos São Vicente, is one of the largest Angolan business groups, operating in the area of insurance and hotels.
