Lusa - Business News - Portugal: Ryanair crew offered contracts below minimum wage or emigration




Lisbon, Aug. 11, 2020 (Lusa) - More than 30 Crewlink workers, who crew Ryanair's planes, are being offered basic salaries below the minimum wage, with the alternative of relocating abroad as early as September.

According to documentation seen by Lusa, employees of Crewlink, a temporary employment agency whose only client is the Irish low-cost company Ryanair, received letters from human resources telling them that a 'limited number' of crew members would be invited to join the staff of Ryanair.

If the proposal is rejected, the workers - based in Ponta Delgada, Lisbon, and Porto - will be relocated to various destinations of the Crewlink network in the United Kingdom and Ireland from 1 September.

According to an exchange of documentation between an employee and the company to which Lusa had access, given the refusal of the employee to sign a contract with Ryanair that proposed a basic gross salary of €588, below the €635 enshrined in law as the Portuguese minimum wage, the company suggested relocation to the United Kingdom (East Midlands or Southend) on 1 September.

"It is regrettable that it rejected Ryanair's proposal," according to a letter to an employee who refused, which also mentioned that the proposal was above €18,500 per year of 850 flight hours.

"Its total remuneration was calculated to include a premium for all hours associated with the flight service, including, but not limited to, reports before and after flights, delays and all tasks on board" as read in the contract proposal.

The document stated that the employee's salary includes a premium for work performed on Sundays and public holidays, excluding automatic increments or salary increases.

In addition to the basic pay, according to the contracts, the employee has the right to receive the 'Flight Pay', which will not be due when they are not available to fly, regardless of the reasons they give the company, and which, according to the company, includes an allowance for meals, drinks and keeping the uniform.

Employees are also eligible for an arbitrary sales bonus, which 'has a non-contractual status' and Ryanair may at any time change, alter or withdraw the bonus, giving one month's notice.

The contract additionally has a clause in which the employee declares not to have any claims/credits against the company as of 1 September 2020.

The documentation consulted by Lusa said that workers are being given two to three days to respond on their basis of preference, as well as being refused requests for relocation to Portugal or postponement of the emigration proposal.

According to figures from Portugal's National Union of Civil Aviation Flight Personnel (SNPVAC), there are in these circumstances three workers from the Ponta Delgada base, 14 from Lisbon (a total of 32), and about 15 from Oporto already contacted (a total of 85).

The union warned on Wednesday that it has learned that the crew of the Porto base, as had already happened at the Lisbon and Ponta Delgada bases, are receiving letters for a passage to Ryanair, being an illegal form of the company to pressure members to accept unqualified conditions.

The union also complained about payments made by the company in July below the national minimum wage.

In response to questions from Lusa, Ryanair confirmed that it will not use members from the subcontractor Crewlink in Portugal during the winter season.

The company offered a limited number of Crewlink employees direct employment with Ryanair, in a remuneration package of more than €18,000 per year (significantly more than the Portuguese minimum wage, according to the reply sent to Lusa.

Ryanair also stated that the remuneration of its cabin crew in Portugal consists of many elements including basic payment, payment for flights, sales bonuses and annual allowances and that all payment elements are referenced in the contracts.
