Lusa - Business News - Portugal: EDP denies any misdoings in suspension of CEOs

Lisbon,July 7,2020(Lusa)–EDP reiterated that "there was no irregularity that can be attributed to it", following the investigation that led to the suspension of the chairman of the company, António Mexia, and the chairman of EDP Renováveis, João Manso Neto.
"EDP reaffirms that in relation to the matters in question there was no irregularity that can be imputed to it", the company stresses in a statement sent to the Securities Market Commission (CMVM) on Monday evening.
The company adds that "the legal framework in place since 2004, the decisions of the European Commission of 2004, 2013 and 2017 and the studies and independent opinions on these matters show that the amounts due for the termination of the CAEs [energy purchase agreements] and transition to the CMEC [contract balance maintenance costs] and the amount paid for the extension of the use of DPH [public hydric domain] were fair and in accordance with market conditions".
In the statement sent to the market, EDP states that the investigation in which António Mexia and João Manso Neto are involved is related to "the alleged favouring of EDP by securing alleged compensatory payments of around €1.2 billion".
The company maintains that there was "no benefit to EDP from the early transfer of the CAEs and adoption of the CMEC regime", as well as the extension of the "right to use DPH", and, therefore, "all the arguments associated with acts of favor to EDP are unfounded".
EDP adds that it "remains firm in the fulfillment of its corporate purpose".
António Mexia, chairman of EDP, and João Manso Neto, chairman of EDP Renováveis, were suspended from their functions in the company as a measure of coercion decided by judge Carlos Alexandre in the EDP case.
Both Mexia and Manso Neto are still obliged to a bail bond of one million euros each.
Following the application of these coercive measures, EDP informed the CMVM last tonight that the financial director, Miguel Stilwell de Andrade, is the acting CEO of the company, in addition to his current duties.
The defendant João Conceição, director of REN, was obliged, by decision of the judge at the inquiry stage, to pay a bond of €500,000, but was not suspended from office.
The defence of António Mexia and Manso Neto had considered the coercive measures proposed by the Public Prosecutor's Office to be illegal, claiming that there were no new facts to justify the increase in the coercive measures.
The team of defence lawyers, led by João Medeiros, also filed a request for the removal of Judge Carlos Alexandre, which the Lisbon Court of Appeal rejected.
According to a recent information from the Central Investigation and Penal Action Department (DCIAP), four crimes of active corruption and one crime of economic participation in business are charged to António Mexia and Manso Neto in co-authorship.
The defendant João Conceição, administrator of REN, is charged with two crimes of passive corruption for illicit acts.
The inquiry investigates the procedures regarding the introduction in the national electricity sector of CMEC, with António Mexia and João Manso Neto being charged in June 2017 with suspicions of active corruption and economic participation in business.
EDP's excessive rent process has been under investigation by DCIAP for about eight years.
