Lusa - Business News - Portugal: Azores airlines bidder to go to court over cancellation
Lisbon, May.3,2024(Lusa) - The consortium bidding for the privatisation of Azores Airlines, Newtour/MS Aviation, is threatening to "resort to all legal mechanisms at its disposal" after the Azores government cancelled the tender. "The Newtour/MS Aviation consortium learned on Thursday, through the media, of the decision taken by the Azores regional government not to proceed with the privatisation process of Azores Airlines due to an alleged significant change in the economic and financial conditions taken into account in the initial evaluation of the airline," the note said. The organisation stressed that throughout the process, "it was always committed to the success of the operation" and that it remained "silent in the interests of independence, transparency and, above all, institutional respect for all those involved", namely "SATA Internacional and its employees". However, he said, in view of this decision, "silence no longer makes sense". "Newtour/MS Aviation does not agree with the regional government's decision not to proceed with the privatisation process of Azores Airlines," he said, adding that he was "formally unaware of the reasons behind this decision". The consortium believes that "the reason given is unfounded, namely because the negotiation phase provided for in the tender rules could accommodate a possible change in the economic and financial conditions taken into account in the initial evaluation of the airline". "Newtour/MS Aviation is surprised that it has been denied access to various tender documents, in particular the final report drawn up by the jury, since it has requested this several times and through the proper channels," indicating that "it only knows what has been published by the media." For this reason, "the consortium will analyse the grounds put forward by the Regional Government of the Azores and use all the legal mechanisms at its disposal," adding that "it will do everything it can to defend, on the one hand, the future of SATA Internacional — Azores Airlines and its employees and, on the other hand, the position of the consortium members whose credibility and reputation were called into question during the tender." The government of the Azores has cancelled the privatisation tender for Azores Airlines and will launch a new one, claiming that the company was valued at €6 million at the start of the process and is now worth 20 million. "[The Council of Government] decided not to proceed with the privatisation process of Azores Airlines due to the significant change in the economic and financial conditions taken into account in the initial valuation of the company. This cancels the current privatisation process for Azores Airlines," announced Artur Lima, vice-president of the Regional Government of the Azores (PSD/CDS-PP/PPM). At the beginning of April, the jury of the public tender for the privatisation of Azores Airlines delivered its final report and upheld the decision to accept only one bidder, but acknowledged reservations about the ability of the Newtour/MS Aviation consortium to ensure the company's viability. The Board of Directors of the SATA group, led by Teresa Gonçalves, who has since resigned, also expressed "reservations about the Newtour/MS Aviation consortium and the limitations of the competitor" in the opinion sent to the Regional Government.
