Lusa - Business News - Portugal: Worldcoin responds to order to suspend collection of iris, face data

Lisbon,March.26,2024(Lusa)-The Worldcoin Foundation,a crypto biometrics venture that has been barred from most European countries, said on Tuesday that it is in compliance with Portugal's laws on the collection of biometric data, after the country's National Data Protection Commission (CNPD) ordered it to suspend the collection of iris and face data.
"Worldcoin is in full compliance with all laws and regulations governing the collection and transfer of biometric data, including Europe's General Data Protection Regulation," said the Data Protection Officer at the Worldcoin Foundation, Jannick Preiwisch, in a written response to Lusa.
The statement also says that the company "has the utmost respect for the role and responsibilities of data protection authorities, including the CNPD in Portugal," to which it says it has shown willingness to respond to questions or concerns.
"The CNPD's report is the first contact we have from them on many of these issues, including the issue of verifications by minors in Portugal, for which we have zero tolerance and are working to resolve in all instances, even if there are only a few situations," Worldcoin emphasises.
In a statement released earlier on Tuesday, the CNPD explained that the company has already been informed of this temporary suspension, which runs until the investigation is completed and a final decision is issued on the matter.
The adoption of this urgent provisional measure followed "dozens of complaints" received by the CNPD in the last month, reporting the collection of data from minors without the authorisation of their parents or other legal representatives, as well as deficiencies in the information provided to data subjects, the impossibility of deleting data or revoking consent.
Following these complaints, the CNPD earlier this month advised citizens to think very carefully before handing over this data.
The CNPD also said that news coverage in the media had brought to its attention that more than 300,000 people in Portugal had already provided their biometric data - a prerequisite for receiving a certain amount of the Worldcoin cryptocurrency.
The company began taking digital images of the irises of people who voluntarily submitted to this registration in exchange for compensation in cryptocurrencies (a virtual currency used on the internet) equivalent to around €70.
The number of places where data is collected using the "Orb" device, located in large shopping centres, has almost doubled in six months.
"The large influx of people, including minors, joining the Worldcoin project and receiving 'tokens' (cryptocurrency) has led to the need to pre-book the registration process and collect biometric data," the CNPD notes, emphasising that there is "no mechanism for verifying the age of adherents" as part of the procedure.
The CNPD said that its "urgent intervention" was justified to "prevent serious or irreparable damage" on the basis that the risk to citizens' fundamental rights is high.
Quoted in a statement, the president of the CNPD, Paula Meira Lourenço, considered that "this order to temporarily limit the collection of biometric data by the Worldcoin Foundation is, at the moment, an indispensable and justified measure to achieve the useful effect of defending the public interest in safeguarding fundamental rights, especially those of minors."
The CNPD said it is continuing its investigation, with "additional diligence" and analysing the reports it continues to receive on a daily basis, with a view to finalising the process.
At the beginning of the month, Spain's Data Protection Agency (AEPD) ordered the suspension of Worldcoin's activity in the country.
The AEPD had announced on 20 February that it was opening an investigation into the company's activity following four complaints it had received.
At the time, Worldcoin accused the EDPS of "circumventing the law" in the European Union and spreading "inaccurate and misleading statements" about its technology.
